TERMS AND CONDITIONS FOR DOCIFY.ONLINE

1. ACCEPTANCE OF TERMS

By accessing or using docify.online (“Site”),  “we,” “us,” or “our”), you (“User,” “you,” or “your”) expressly acknowledge, represent, and warrant that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”), including all disclaimers, limitations of liability, indemnification provisions, and dispute resolution mechanisms contained herein. Your continued use of the Site constitutes your ongoing acceptance of these Terms. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST IMMEDIATELY CEASE USING THE SITE.

2. SERVICES DESCRIPTION

Docify.online provides a digital platform connecting users with registered medical practitioners for the following services:

  • Online medical consultations
  • Issuance of medical certificates (subject to practitioner discretion and legal requirements)
  • Facilitation of doctor-patient communication

IMPORTANT NOTICE: Docify.online is NOT a substitute for emergency medical services or comprehensive in-person medical care. In case of medical emergency, Users MUST contact emergency services of your state and country immediately.

3. USER ACKNOWLEDGEMENTS AND REPRESENTATIONS

By using the Site, you expressly acknowledge, represent, and warrant that:

3.1 You are at least 18 years of age or accessing the Site under the supervision of a parent or legal guardian.

3.2 You will provide accurate, current, and complete information during registration and use of the Site.

3.3 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

3.4 You understand and accept that online medical consultations have inherent limitations and may not be appropriate for all medical conditions.

3.5 You acknowledge that the issuance of medical certificates is at the sole professional discretion of the consulting practitioner and is subject to their clinical judgment, professional ethics, and applicable regulations.

3.6 You understand that NO GUARANTEE is provided regarding the issuance of medical certificates.

3.7 You agree to use the Site only for lawful purposes and in compliance with all applicable laws, regulations, and guidelines including but not limited to those related to healthcare, telemedicine, privacy, and data protection.

3.8 You will not use the Site to:

  • Engage in any illegal, fraudulent, or deceptive activities
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Site or its systems
  • Interfere with or disrupt the Site or servers
  • Transmit viruses or malicious code
  • Collect information about other users without consent
  • Seek medical certificates for fraudulent purposes

4. MEDICAL PRACTITIONERS’ OBLIGATIONS

Medical practitioners using our platform:

4.1 Must be duly qualified and registered with the appropriate medical council in India with a valid registration number.

4.2 Are required to provide services in accordance with applicable professional standards, ethical guidelines, and regulations including but not limited to the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, and the Telemedicine Practice Guidelines, 2020.

4.3 Are independent contractors and not employees of Docify.online.

4.4 Maintain complete professional autonomy and discretion regarding patient care decisions.

4.5 Are solely responsible for the medical advice, treatment recommendations, and certificates they provide.

5. DISCLAIMERS AND LIMITATION OF LIABILITY

5.1 COMPREHENSIVE MEDICAL DISCLAIMER: The information provided on the Site and during consultations is for informational purposes only and DOES NOT constitute medical advice, diagnosis, or treatment. Users must consult with qualified healthcare professionals for personalized medical advice. NO DOCTOR-PATIENT RELATIONSHIP is established merely by accessing the Site or reviewing information contained therein.

5.2 WAIVER OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY WAIVE, RELEASE, AND FOREVER DISCHARGE DOCIFY.ONLINE, ITS PARENT COMPANY, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, MEDICAL PRACTITIONERS, AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS (COLLECTIVELY, “RELEASED PARTIES”) FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LIABILITIES, LOSSES, DAMAGES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS’ FEES) OF ANY KIND OR NATURE WHATSOEVER, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, WHETHER ARISING IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY RELATED TO:

  • YOUR USE OF THE SITE
  • MEDICAL ADVICE OR CONSULTATIONS PROVIDED THROUGH THE SITE
  • ISSUANCE OR NON-ISSUANCE OF MEDICAL CERTIFICATES
  • ACTIONS OR OMISSIONS OF MEDICAL PRACTITIONERS OR OTHER HEALTHCARE PROFESSIONALS
  • ANY TECHNICAL FAILURES OR INTERRUPTIONS IN SERVICE
  • ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA

5.3 LIMITATION OF DAMAGES: UNDER NO CIRCUMSTANCES SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5.4 IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

5.5 THE TOTAL LIABILITY OF THE RELEASED PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

6. INDEMNIFICATION

6.1 You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including attorneys’ fees) arising from:

  • Your use of the Site or Services
  • Your violation of these Terms
  • Your violation of any third-party rights, including privacy or intellectual property rights
  • Any content you submit, post, or transmit through the Site
  • Your interactions with medical practitioners
  • Any misrepresentation made by you

6.2 COMPREHENSIVE IMMUNITY PROVISION: You expressly and unequivocally agree that no officer, director, employee, contractor, agent, medical practitioner, or other representative of Docify.online shall be personally liable or subject to any legal proceedings, civil or criminal, for any act or omission relating to the provision of services through the Site. You further agree not to name any such individuals as defendants or parties in any legal proceedings arising out of or related to these Terms or your use of the Site.

6.3 This indemnification obligation shall survive the termination of these Terms and your use of the Site.

7. INTELLECTUAL PROPERTY

7.1 All content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Docify.online or its content suppliers and is protected by Indian and international copyright, trademark, and other intellectual property laws.

7.2 You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes in accordance with these Terms.

7.3 You shall not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site without our prior written consent.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

8.2 MANDATORY ARBITRATION: Any dispute, controversy, or claim arising out of or relating to these Terms, the Site, or the services provided thereon shall be resolved by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in our cgoice of city, and our choice of country, in the our choice of language, by a sole arbitrator appointed by the Company.

8.3 WAIVER OF CLASS ACTIONS: YOU AGREE TO RESOLVE ANY DISPUTES WITH US ON AN INDIVIDUAL BASIS ONLY AND WAIVE ANY RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

8.4 FORUM SELECTION: For any disputes not subject to mandatory arbitration, you agree that the courts located in our choice of city, our choice of country and we shall have exclusive jurisdiction over such disputes, as you may understand that we are a global body and it is impossible for us to set up offices in all nations.

8.5 LIMITATION PERIOD: Any claim or cause of action arising out of or related to these Terms or the use of the Site must be filed within one (1) month after such claim or cause of action arose, or be forever barred.

9. MODIFICATIONS TO TERMS

9.1 We reserve the right to modify, amend, or update these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Site.

9.2 Your continued use of the Site following the posting of revised Terms constitutes your acceptance of such changes.

9.3 It is your responsibility to review these Terms periodically for changes.

10. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of the Terms will continue in full force and effect.

11. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional terms or conditions that may apply to specific sections of the Site or to products or services available through the Site, constitute the entire agreement between you and us regarding the Site and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and us regarding the Site.
